This agreement is between you and Codeaamy Private Limited, Pune, India ("Codeaamy", "we", "us"). It covers the SimWin app for macOS, the simwin command-line tool, and their updates (together, "SimWin"). By installing or using SimWin, you agree to it. If you don't agree, don't install or use SimWin.
1. Beta software
SimWin is in beta. It may contain bugs, it may change, and features may be added or removed. SimWin makes debug builds for testing; it is not meant to produce the software you ship. Always test your app on Windows itself before you release it.
2. What you may do
We grant you a free, non-exclusive, non-transferable licence, which we can revoke, to install and use SimWin on Macs you own or control, to develop and test your own apps, for personal or commercial work. Your employer may let its staff use SimWin under this agreement.
The apps you build and test with SimWin are yours. This agreement gives us no rights to your code or your apps.
3. What you may not do
Except where the law allows it regardless of this agreement, you may not:
- sell, rent, lend, sublicense or redistribute SimWin, or offer it as a hosted service; point people to simwin.dev instead;
- modify, decompile or reverse engineer SimWin, except the open-source components described in section 4;
- remove or change SimWin's copyright and licence notices;
- use the SimWin name or icon in a way that suggests we endorse you or your product;
- use SimWin to break the law or anyone else's rights, including the licence terms of other software.
4. Open-source components
SimWin includes, and downloads during setup, open-source software such as Sparkle, Wine, DXVK, MoltenVK, llvm-mingw, CMake, Ninja and Flutter's Windows engine files. Each is licensed under its own terms, which are listed in SimWin ▸ About SimWin and included in SimWin.app/Contents/Resources/licenses. Nothing in this agreement limits your rights under those licences. Wine is licensed under the GNU LGPL; how to get its source code is described in WINE_SOURCE_OFFER.md.
SimWin does not include or download Microsoft software. Windows is a trademark of Microsoft Corporation, Flutter is a trademark of Google LLC, and Mac and macOS are trademarks of Apple Inc. SimWin is not affiliated with, or endorsed by, Microsoft, Google, Apple or the Wine project.
5. Updates and changes to this agreement
SimWin checks for updates and offers to install them. This agreement applies to updates too. We may change this agreement; a new version applies to SimWin releases published after it, and we will mention the change in the release notes.
6. Privacy
SimWin has no analytics, no tracking and no account, and your code stays on your Mac. The details are at simwin.dev/privacy/.
7. Ownership
SimWin is licensed, not sold. Codeaamy owns SimWin, including its name and icon, apart from the open-source components in section 4, which belong to their authors.
8. No warranty
SimWin is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We don't promise that SimWin will be error-free, that it will work with every Flutter project or plugin, or that an app which works in SimWin will work the same way on Windows.
9. Limitation of liability
To the fullest extent the law allows, Codeaamy is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from your use of SimWin, even if we were told they were possible. Our total liability for any claim about SimWin is limited to the amount you paid us for SimWin in the twelve months before the claim (nothing, while SimWin is free) or INR 1,000, whichever is greater.
10. Ending this agreement
You can end this agreement at any time by deleting SimWin. It ends automatically if you break it; you must then stop using SimWin and delete it. Sections 4 and 7 to 11 continue to apply after it ends.
11. Governing law
This agreement is governed by the laws of India. The courts of Pune, Maharashtra, have exclusive jurisdiction over any dispute about it. If any part of it can't be enforced, the rest still applies.
